The state of Idaho, led by Attorney General Lawrence Wasden and Gov. Butch Otter, is filing a “friend of the court brief” supporting Arizona in its appeal of a new law on illegal immigration.
The U.S. Department of Justice sued Arizona to block the law and won an initial ruling. The law allows police to check the citizenship of anyone they think might be in the country illegally if they have been detained for another possible offense. A federal judge issued a temporary injunction blocking that portion of the plan from going into effect.
Much of the legal debate over the law centers around whether the state immigration law trumps federal laws on the books. Idaho’s legal brief contends that Arizona’s law is consistent with current immigration practices.
“Arizona is simply requiring its law enforcement officials to help the federal government enforce immigration law as envisioned by Congress,” Otter said in a news release. “State officials have the right under existing federal law to identify illegal aliens and report them to federal authorities. It’s our affirmative duty to protect states’ rights, and that’s particularly important when a lawsuit seeks to punish a state for doing what the federal government has failed to do – protect our borders and American citizens.”
The Arizona law was scheduled to go into effect in July, before the federal judge issued the injunction. Arizona’s appeal to the 9th Circuit Court of Appeals is set to be heard in November, according to Reuters. Idaho joins Michigan in filing an amicus curiae brief to the appeals court.
Arizona’s law has garnered national headlines. One north Idaho lawmaker has plans to introduce a similar proposal during the next legislative session.
